2023 Sunset Beach Boat Launch Use Agreement

    Exclusively for Property Owners in the Sunset Beach at Lake Diefenbaker Development

    STEP 1. Complete the Registration Form

    • Please ensure that you have read the agreement thoroughly and have typed your initials beside each paragraph to confirm you agree to be bound by the terms and conditions of the same.

    • Please note that we require a completed agreement for boat launch use.

    STEP 2. Remit Payment

    • Full payment is due before a key will be provided to new customers, or reactivated for returning customers. Payment shall be $50 for a Key Fob for new customers or replacement Key Fobs for returning customers; Boat Launch Access for both new and returning customers is $175 if paid by March 1, 2023 (EARLY BIRD OFFER HAS ENDED FOR 2023), or $250 after March 1st.

    By completing and submitting this form, I acknowledge that I have read the Terms and Conditions attached hereto and that the terms of the same are hereby incorporated into this agreement and form an integral part of this lease agreement. I agree to be bound by the Prairie’s Edge Development Corporation/Sunset Beach Boat Launch Terms and Conditions. I further agree:

    1. TO ASSUME AND ACCEPT ALL RISKS arising out of, associated with, or related to my/my child’s/my guests and invitees use of the boat launch and associated amenities located in the Sunset Beach Development at Lake Diefenbaker, even if such risks may have been caused by the negligence of Prairie’s Edge Development Corporation.

    2. TO BE SOLELY RESPONSIBLE FOR ANY INJURY, LOSS, OR DAMAGE which I/my child/my guests and invitees might sustain while using the boat launch and associated amenities at Sunset Beach, even if such loss or damage may have been caused by the negligence of Prairie’s Edge Development Corporation.

    3. TO HOLD HARMLESS AND INDEMNIFY Prairie’s Edge Development Corporation

      • a. From any and all liability for any damage to the personal property of, or personal injury to, any third party resulting from my/my child’s/my guests and invitees use of the boat launch, and associated amenities and

      • b. From any and all claims, demands, actions, and costs which might arise out of my/my child’s/my guests and invitees use of the boat launch and associated amenities, even though such claims, demands, actions and costs may have been caused by the negligence of Prairie’s Edge Development Corporation.

    I, THE UNDERSIGNED, ACKNOWLEDGE THAT I HAVE CAREFULLY READ THE ABOVE RELEASE OF LIABILITY AND FULLY UNDERSTAND ITS CONTENTS AND THAT I FULLY AGREE WITH ITS TERMS AND CONDITIONS. I UNDERSTAND THAT BY SIGNING THIS RELEASE OF LIABILITY I AM KNOWINGLY AND WILLINGLY AGREEING TO RELEASE PRAIRIE’S EDGE DEVELOPMENT CORPORATION FROM ALL LIABILITIES INCIDENT TO MY/MY CHILD’S USE OF THE BOAT LAUNCH AND ASSOCIATED AMENITIES INCLUDING, OF ALL LIABILITY FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, OR WRONGFUL DEATH CAUSED BY THE NEGLIGENCE OF ANY SAID PERSON OR OTHERWISE.

    This agreement is to be binding upon myself, my heirs, executors, administrators, and assigns, in the event of my death or incapacity.

    Sunset Beach Boat Launch Terms and Conditions


    (Please type your initials beside each statement to confirm you have read and understand the terms of the same, and agree to be bound by these terms).

    1.0 The Boat Launch is unsupervised. Lessee’s, their invitees, guests, agents and assigns, use the facility at
    their own risk. Children under 16 years of age must be accompanied by a parent or guardian.

    2.0 No alcoholic beverages are to be consumed on the Prairie’s Edge Development Corporation property.

    3.0 Life jackets should be worn on the dock while entering and departing the boat and while moving along the
    boat launch system.

    4.0 The anticipated season for boat launch operation runs from May 1st - September 30th; however
    management reserves the right to extend or abbreviate the season at their discretion to account for weather,
    required repairs and maintenance, etc. In the event operation of the boat launch use season is shortened, there
    shall be no adjustment, abatement, or apportionment to the yearly rental fee.

    5.0 There is a NO WAKE zone in the inlet near the boat launch. The lessee is responsible for ensuring that
    their watercraft adheres to this rule. The owner of watercraft is strictly liable for all actions of anyone operating
    their watercraft. In the event this rule is violated, the owner may have their lease terminated immediately,
    without any right of refund, abatement, adjustment, or compensation.

    6.0 Trailers may NOT be left in the turn around area immediately adjacent to the boat launch. There is ample
    parking available across from the boat launch. If a trailer is left overnight, the trailer may be towed or removed.
    Any moving, storage, and removal fees incurred will be charged to the Lessee.

    7.0 Any vandalism or damage to the boat launch, marina, or grounds that is deemed to be the responsibility of
    the Lessee will be the responsibility of the Lessee. Prairie’s Edge Development Corporation reserves the right
    to invoice any costs associated with the damages to the Lessee.

    8.0 The boat launch gate key fob system will be activated again this season. New lessees will be provided with a
    single key fob at the start of the season at the cost stated in this agreement. Returning lessees will use the key fob they received in the previous year. This key fob provides boat launch access to the Lessee, a property owner in the Sunset Beach development exclusively, their family, and accompanied guests. Unauthorized use of the boat launch and marina are strictly prohibited and may result in termination of the lease agreement without refund. Replacement key fobs will be available for a fee by contacting Prairie’s Edge Development Corporation.

    9.0 The Lessee agrees to lock the gate after using the boat launch each and every time.

    10.0 Prairie’s Edge Development Corporation reserves the right to cancel this lease agreement for any reason
    whatsoever, that Prairie’s Edge Development Corporation, in its sole discretion determines, and a prorated
    annual lease fee will be refunded to the Lessee. Reasons for termination of this lease agreement may include
    failure to operate in a safe manner respectful to neighbors or the environment, providing keys and/or marina
    access to unauthorized persons, etc. In the event of cancellation of the lease for reasons pertaining to violation
    of the NO WAKE rules contained in Section 5.0 herein, there shall be no right of refund, abatement, adjustment,
    or compensation to the Lessee.

    11.0 The Sunset Beach Boat Launch is an unsupervised, unmonitored facility. Prairie’s Edge Development
    Corporation and affiliates will not be held responsible for any theft or damages to individual boats or the
    contents of boats while using the boat launch.

    12.0 All Lessees are responsible to ensure that they have complied with the following rules and regulations in
    relation to preventing the introduction and spread of invasive species (including but not limited to whirling
    disease, zebra mussels, eurasion water milfoil, and purple loosestrife) into Lake Diefenbaker. Before returning
    home from out of province, coming to visit, or moving between waters within the province, please follow these
    important steps to help protect Saskatchewan waters.

    13.0 The boat launch will be closed from November 15th until April 15th annually (lake freeze up until spring thaw) and Lessees agree that the boat launch will not be used to access the lake or ice surface during this time to protect the integrity of the launch.

    • CLEAN and inspect the watercraft, trailer, equipment, and all gear that made contact with the water.
      Remove all visible plants, animals, and mud. Scrub/scrape grainy surfaces that feel like sandpaper, as this could be young mussels too small to see.
      Wash, scrub, or rinse using high pressure, hot tap water preferably 50oC (120 oF) – away from storm drains, ditches, and waterways.
      Inspect the watercraft, trailer, and vehicle.

    • DRAIN all on-board water from the motor, live well, bilge, and ballast tanks.
      Flush with hot tap water away from storm drains, ditches, and waterways. Then leave plugs out during transport and storage.

    • DRY your watercraft, equipment, and all related gear completely, preferably for at least five days while leaving compartments open to dry.

    • DISPOSE of all unwanted bait in the trash. Never release leftover leeches or crayfish, aquarium pets, plants or water into our lakes, rivers, or wetlands.

    • Report any sightings to the nearest Ministry of Environment office or call the TIP Line 1-800-667-7561.
